Terms and Conditions
These conditions outline the terms under which Webstore (i.e. the server managed by Pearson Publishing Group together with the content, search facilities, folder space, web space, and other services provided by Webstore from time to time) is made available to you. By accessing Webstore you agree to be bound by these conditions.
- The details provided by you on registration are important and must be true, correct and complete. You agree to notify us immediately of any changes which are relevant to your registration by informing us at: webstore-admin@pearson.co.uk
- We will respect your registration information and undertake to meet with all applicable UK Data Protection legislation currently in force.
- You agree that Webstore may use your registration data for the purposes of managing your account and access to Webstore.
- Other than as required by law, or as permitted under these user conditions, we will not disclose your registration details to any third party without your permission.
- We agree to use our reasonable endeavours to maintain Webstore in a fully operating condition and error free. As we cannot guarantee that this will always be the case we do not accept responsibility for any defects that may exist, or consequential losses arising from your use of, or inability to access Webstore.
- Webstore is provided without any warranties or guarantees unless specifically stated.
- Under normal working conditions, Webstore on-line services are provided within a service level guarantee of 99% during peak time and 98% at all other times, excluding notified scheduled down time. Peak time is from 8am - 10pm, Monday to Friday, excluding public holidays. 7 days notice will be given of scheduled down time that will account for not more than 1% and will only occur during off peak times. Webstore may be off-line from 2am to 4am GMT daily, to ensure data backup integrity. The stated percentages of service levels are over the annual term of the user agreement. The maximum liability of Webstore will not exceed the cost of the services.
- Should you provide links to other web sites or resources, we are unable to accept responsibility for these or their content in any way.
- We reserve the right to suspend, restrict, or terminate your access to Webstore for any reason.
- In order to maintain the integrity of Webstore we reserve the right to forward contact details to the Police, or other Regulatory authorities where requested to do so.
- You agree that you will not use Webstore to transmit or store any material which is defamatory, offensive, or of an obscene or menacing character, or which may, in our judgement, cause annoyance, inconvenience or anxiety to any person.
- As an administrator or user of Webstore you are responsible for maintaining the confidentiality of your username, the passwords and permissions assigned to you on registration and those you issue to your user groups and are fully responsible for all activities which occur under them. You must notify us immediately of any unauthorised use to which you become aware.
- You are responsible for obtaining the equipment and paying connection charges necessary to access and use Webstore. Although the Webstore system and site management will include backup procedures, you are responsible for making your own backup arrangements.
- You agree that the material and content contained within or provided by Webstore is for your personal use only and may not be used for commercial purposes or distributed commercially without our permission. Your use of Webstore carries with it no rights in relation to copyright, trade marks or other intellectual property rights in Webstore.
- You agree to partake in any user training or support services Webstore considers appropriate for you to use Webstore facilities effectively and to agree in advance any charges that may apply.
- Webstore will provide a telephone 'Helpdesk' to support users, from 9am to 5pm, Monday to Friday (Excluding public holidays) from September 2001, under normal working conditions.
- You agree not to use Webstore or the services made available to such that you cause the whole or part of Webstore to be overloaded or rendered less efficient.
- These user conditions may be amended from time to time and we will always inform you when they change. They may also be extended to include other conditions applicable to specific products or services offered by Webstore from time to time.
- Webstore contents will be restored with a maximum of 24 hours of data loss following a Webstore system problem.
- Webstore is not responsible for data loss arising from the actions or inactions of viruses or any other software applications that may run on the client system.
- Webstore is not required to restore any changes made to files hosted on Webstore by authorized users. However efforts would be made to assist in this matter where possible at a nominal charge where appropriate. (Please note that password security is the responsibility of the user and anyone who can supply a correct username and password is an authorized user, regardless of their actual identity.)
